1. Platform Purpose

ServiceMarketUSA operates as a decentralized local business directory and digital visibility platform designed to connect consumers with independent trade professionals and service providers across regional markets.

The platform does not operate as a lead brokerage, employment agency, contractor network operator, or escrow intermediary.

2. Independent Contractor Status

All businesses, contractors, technicians, agencies, and professionals listed inside ServiceMarketUSA directories are fully independent third-party entities.

• ServiceMarketUSA does not employ or supervise listed contractors.
• We do not guarantee workmanship quality, project completion, pricing accuracy, licensing validity, or contractor behavior.
• All project negotiations, quotes, invoices, payments, and agreements occur directly between the customer and the contractor.
• Consumers are solely responsible for verifying licensing, insurance, permits, and compliance requirements before hiring any listed provider.

3. Subscription Advertising Services

ServiceMarketUSA offers recurring monthly advertising subscriptions for digital placement inside local city directories, state hubs, and promotional sections.

• Subscription plans renew automatically every month unless canceled.
• Subscriptions provide advertising visibility and directory placement only.
• ServiceMarketUSA does not guarantee lead volume, phone calls, WhatsApp inquiries, sales conversions, or customer acquisition results.
• Placement positioning may vary based on platform structure updates, design adjustments, or regional optimization efforts.

4. Cancellation & Refund Policy

Customers may cancel their subscription at any time through Stripe billing management or by contacting our administrative support team.

• Cancellation prevents future recurring charges.
• No cancellation penalties or long-term contracts apply.
• Previously processed subscription periods are non-refundable once advertising placement has been activated.
• Refund requests related to duplicate charges or technical billing errors are reviewed individually.
• Customers must report billing disputes within 7 days of the transaction date.

5. Limitation of Liability

Under no circumstances shall ServiceMarketUSA, its owners, administrators, developers, or affiliates be held liable for:

• Contractor negligence or defective workmanship.
• Property damage, project delays, permit violations, or construction failures.
• Indirect, incidental, or consequential damages arising from contractor relationships.
• Loss of profits, business interruptions, or advertising performance expectations.

6. Platform Ownership & Branding

The ServiceMarketUSA platform is owned, managed, and operated by NITU M. ADRIAN PFA, registered and compliant under the commercial regulations of Romania and the European Union.

The trademarks, commercial branding, platform identity, and associated digital assets including ServiceMarketUSA and ServiceMarketUSA.com are administered and legally controlled by NITU M. ADRIAN PFA.

Unauthorized reproduction, cloning, scraping, automated extraction, branding imitation, or commercial duplication of the platform structure or content is prohibited without written authorization.

7. Governing Law

These Terms of Service shall be governed and interpreted under the applicable laws of Romania and the European Union.

Any disputes arising directly from the use of the ServiceMarketUSA platform shall fall under the exclusive jurisdiction of the competent courts located in Romania.
